Participation
All Ship.com registered users with an active subscription are eligible to participate in the Ambassador Affiliate Program (AAP). Participation in the AAP is completely voluntary and users must fully complete the registration process to participate.
The following Terms and Conditions apply.
Referral Activation
Those who wish to participate in the AAP must use their Referral Link to refer individuals to Ship.com. Each Individual who creates an account with a qualified paid subscription through the User’s Referral Link will count as one (1) valid Referral. There will be no limit to how many Individuals can sign up for an account with a participants Referral Link. Once a referral has made a monetary transaction within Ship.com then they are considered an Eligible Referral; they must also complete their first transaction within 60 days of signing up for their account.
Program Start Date
Participation in the AAP begins when the User logs in and enrolls in the program via their Ship.com Ambassador Affiliate Dashboard.
Affiliate Compensation
Those who wish to participate in the affiliate program will share their unique referral link to generate referrals within the system. Affiliates will receive 10 percent of fees collected generated directly on their first level referrals’ subscription fees for the following 12 months from their sign up date. Affiliates may also receive a Quick Start Bonus of $500 if they successfully refer ten (10) unique Eligible Referrals within the first thirty (30) days of being an Affiliate.
Payouts
Payouts are determined individually according to the number of active referrals. The Payout amount is finalized at the end of each calendar month and paid by the last day of the next calendar month. Ship.com reserves the right to reverse payouts at any time caused by, but not limited to, cancellations, refunds, duplicates, or fraud. Payments will be paid through Ship.com’s invoicing system via Stripe if the amount is greater than $25. Partners must be enrolled in the Ship.com Payout System to receive payment. Affiliates will receive all payments to their Shipping Balance. Ship.com reserved the right to adjust payouts at any time for any reason.
Eligibility
You must be at least eighteen (18) years old at the time of enrollment to be eligible to participate. By participating, the Affiliate Ambassador agrees to abide by these rules and the decisions of Ship.com, which are final and binding in all respects. This program is void in all jurisdictions where it is prohibited by law. All Referrals are subject to verification by Ship.com, whose decisions are final and binding in all matters related to the program. An Affiliate Ambassador is eligible to receive a Payout when the participant has agreed to the Ship.com’s Affiliate Terms and Conditions and their participation has been confirmed via email by Ship.com.
Taxes
Participants are solely responsible for all federal, state, local taxes, and other fees associated with compensation. No substitution (including cash where applicable), assignment, or transfer of payouts are permitted, except by Ship.com. Ship.com will withhold and/or report taxes as required by applicable laws.
Publicity
Except where prohibited, participation in the Program constitutes participants consent to Ship.com's use of participants name, likeness, voice, image, opinions, hometown, state/province, and country for promotional purposes in any media or channel without further payment or consideration. Affiliates Ambassadors may not use any Ship.com branded material outside of that expressly approved for use in the AAP.
General Conditions
Ship.com reserves the right, in its sole discretion, to cancel, modify or suspend the Program at any time for any reason including computer virus, computer bugs, unauthorized human intervention, technical failures or any other factor beyond Ship.com's reasonable control that would corrupt the administration, security, fairness, integrity or proper operation of the program. In such an event, Ship.com reserves the right to provide compensation to eligible Affiliates up to the time of impairment. Ship.com. reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the integrity or the operation of the program or to be acting in violation of these rules, or/and in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage Ship.com’s Web site or undermine the legitimate operation of this program may be a violation of criminal and civil laws, and, should such an attempt be made, Ship.com. reserve the right to seek damages from any such person to the fullest extent permitted by law. Ship.com's failure to enforce any term of these rules shall not constitute a waiver of that provision.
Release
By accepting any payout, Affiliate Ambassador agrees that Ship.com, and their respective parents, subsidiaries and affiliated companies, and the agents, employees, directors, and officers of these companies, are not liable whatsoever for any injuries, losses or damages of any kind resulting in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of any prize, or travel to or from or related to any payout or payout-related activity, or from affiliates participation in the program.
Limitations of Liability
Ship.com is not responsible for:(1) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software, or social media services, as applicable; (2) the unavailability or inaccessibility of any website or service; (3) unauthorized human intervention in any part of the entry process or the program; (4) electronic or human error which may occur in the administration of the program or the processing of entries; or (5) any injury or damage to persons or property, including but not limited to participant’s computer, which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Promotion or from downloading any material from Ship.com's website(s), regardless of whether the material was prepared by Ship.com, a third party, and regardless of whether the material is connected to Ship.com's website by a hypertext link.
Disputes
Affiliate Ambassador agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this program, or any prizes awarded, other than the administration of the program or the determination of winners shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this program but in no event attorneys' fees; and (3) under no circumstances will Affiliate Ambassador be permitted to obtain awards for and Affiliate Ambassador hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Certain jurisdictions may not allow the limitation or exclusion of liability for incidental or consequential damages, in which case the aforementioned will not apply. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participant, Ship.com in connection with the program shall be governed by, and construed in accordance with, the laws of the State of Nevada, U.S.A., without giving effect to any choice of law or conflict of law rules of provisions. All federal, state, provincial and local laws apply.
